This Commission Policy (“Commission Policy”) was last modified on July 21, 2008.

This Commission Policy governs your Rogomo Account and your use of the Service. Please read this Commission Policy carefully, as it comprises a part of the User Agreement between you and Rogomo. For your reference, you can review Rogomo’s User Agreement here. Unless otherwise provided, terms used herein have the same meanings given in the User Agreement.

A. Purchasing Services and/or Goods via the Service

Rogomo does not charge a Commission with respect to a Sale to the User or Users who purchase services and/or goods from an Expert in that Sale. However, such purchasing Users (collectively, “Buyers”) are responsible for those fees, if any, that they agree to pay to an Expert in that Sale, as set forth in more detail in the User Agreement.

B. Selling Services and/or Goods via the Service

1. Commissions. Rogomo charges a Commission to an Expert with respect to certain Sales that an Expert makes via the Service. Specifically:

(a) When an Expert makes a Sale, and Rogomo determines in its sole discretion that the Buyer in such Sale has visited Rogomo as a result of the Expert’s use of an Expert Widget (e.g., the Buyer clicked on a Rogomo badge or banner on the Expert’s web page), no Commission is charged by Rogomo to the Expert with respect to such Sale; and

(b) When an Expert makes a Sale, and Rogomo determines in its sole discretion that the Buyer in such Sale visited Rogomo in any manner not described in Sections 1(a), Rogomo shall charge the Expert a Commission equaling 14.9% of the Sale Price of such Sale.

2. Payment of Commissions to Rogomo. At or about the beginning of each month, Rogomo displays on the My Account section of the Rogomo Web Site for each Expert an invoice for the Commissions that that Expert owes for his or her Sales in the preceding month and in prior months (to the extent that the total Commissions for Sales during such prior months was less than $1.00). Rogomo may also provide an Expert with an invoice via email. Experts must pay Rogomo their invoiced Commissions via PayPal within 15 days of first being invoiced. Failure to timely pay invoiced Commissions to Rogomo may lead to the suspension or closure or your Rogomo Account, and Rogomo may collect Commissions using other collection mechanisms.

All payments of Commissions to Rogomo must be made via PayPal pursuant to the instructions set forth in Rogomo’s invoices.

C. Chargeback/Reversal Fees

Should a User make a payment to Rogomo for Commissions or otherwise, and should such payment be subject to a chargeback or reversal such that Rogomo is forced to repay or otherwise forfeit such payment, Rogomo may charge that User a $25.00 USD fee per chargeback or reversal. In addition, in such circumstances, Rogomo reserves its right to payment from the User for such Commissions or other payment, and reserves its rights to recover such Commissions or other payment by any means of legal recourse available to it.

D. Records Request Fees

Rogomo charges a fee of $10.00 USD per item for any records requests by a User. However, we will not charge you for records requested in connection with your good faith assertion of an error in your Account.
