This Privacy Policy (“Privacy Policy”) applies to all Users of the Service and/or the Rogomo Web Site, as well as all Accounts, except that those portions of this Privacy Policy that are in italic bold font apply solely to those Users using the Service and/or the Rogomo Web Site, as well as all Accounts created, after 12:00 a.m. Eastern Time (U.S.), Saturday, May 17, 2008.

This Privacy Policy applies to your use of the Service and/or the Rogomo Web Site, and governs your Rogomo Account and any Information you provide on this site. Unless otherwise provided, terms used herein have the same meanings given in the User Agreement.

A. Overview

This Privacy Policy describes the Information Rogomo Inc. (“Rogomo” or “we”) collects and how we use that Information, including Information about you, your credit/debit card and, in some instances, your PayPal account.

Rogomo takes the privacy of your Information very seriously and will use your Information only in accordance with the terms of our User Agreement and this Privacy Policy. We will not sell or rent your personally identifiable Information or a list of our customers to third parties. However, as described in more detail in our User Agreement and Part C below, there are limited circumstances in which some of your Information will be shared with third parties, under strict restrictions, so it is important for you to review this Privacy Policy and our User Agreement.

By using the Service and/or the Rogomo Web Site, you expressly consent to our use and disclosure of your Information in the manner described in our User Agreement and this Privacy Policy. If you object to your Information being used in the manner described in our User Agreement and this Privacy Policy, you may not use the Service or the Rogomo Web Site.

Notification of Changes

This Privacy Policy may be revised over time as new features are added to our Service and/or the Rogomo Web Site or as we incorporate suggestions from our customers. If we are going to use or disclose your personally identifiable Information in a manner materially different from that stated at the time we collected such Information, you will have a choice as to whether or not we may use or disclose your personally identifiable Information in this new manner. Any material changes to this Privacy Policy will be effective only after we provide you by email with at least 30 days’ notice of the amended Privacy Policy (if you have closed your Rogomo Account, you will not be contacted to notify you of the amended Policy and your personal Information will not be used or disclosed in this new manner).

We will post the amended Privacy Policy prominently on the Rogomo Web Site so that you can always review what Information we gather, how we might use that Information, and whether we will disclose it to anyone. Please check the Rogomo Web site at blog.rogomo.com/privacy at any time for the most current version of our Privacy Policy.

Third Party Websites

The Rogomo Web Site may include links to third party Web sites. These sites are governed by their own privacy statements and Rogomo is not responsible for their operations, including, but not limited to, their information practices. Users of the Service and/or the Rogomo Web Site (“Users”) submitting information to or through these third party Web sites should review the privacy statement of these sites before providing them with personally identifiable information.

Special Note About Minors

Minors may not create or maintain their own Rogomo Account, and may only use the Service as specifically set forth in the User Agreement. We ask that Minors do not submit any personal Information to us or anyone else while using the Rogomo Web Site or the Service.

B. Information We Collect

Required Information

To create a Rogomo Account, you must provide Rogomo with your name, address, email address and, if you are signing up as an Expert, PayPal account information, and, at your option, a telephone number.

Additionally, we may require all Users creating a Rogomo Account to provide us with the following information from a valid credit card or debit card held in your name: card number; the expiration date of such card; and the security code of such card. This information is used for the sole purpose of effectuating a one-time AVS (Address Verification System) check, which may include effectuating and voiding a small authorization amount to your card, to verify your name and address to the extent possible. This verification is done to ensure the safety and security of the Rogomo community, and Rogomo does not store or in any manner keep your credit card or debit card number, expiration date or security code after such verification is complete.

We also ask you to create a security question to answer (such as the brand of your first car or the name of your first pet). Among other things, this Information is necessary to enable Users to pay for and/or receive payment for services and/or goods exchanged via the Service, to allow Rogomo to verify Users’ identity and eligibility for use of the Service, and to allow Rogomo to contact Users with respect to customer service issues.

For all Rogomo Accounts, we also collect the Internet address (IP address) of the computer or device you use to access your Rogomo Account, in order to help detect possible instances of unauthorized transactions.

Information About You From Third Parties

In order to protect against potential fraud, we may verify with third parties the Information you provide when creating a Rogomo Account as further described in Part C below. In the course of such verification, we may receive personally identifiable Information about you from such services.

Website Traffic Information

Because of the way that World Wide Web communication standards work, when you arrive at or leave the Rogomo Web Site, we automatically receive the Web address of the site that you came from or are going to. We also collect information on which pages of our Web site you visit while you are on the Rogomo Web Site, the type of browser you use and the times you access the Rogomo Web Site.

Our Use of “Cookies”

“Cookies” are small files of data that reside on your computer and allow us to recognize you as a Rogomo User if you return to the Rogomo Web Site using the same computer and browser. We may send a “session cookie” to your computer if and when you sign-in to your Rogomo Account by entering your Rogomo identification name (“Rogomo ID”) and password, and/or when you visit Rogomo via a promotional tool. These cookies allow us to recognize you if you visit multiple pages on the Rogomo Web Site during the same session, so that you don’t need to re-enter your password multiple times. One you log out or close your browser, these session cookies expire and no longer have any effect.

We may also use longer-lasting cookies to display your Rogomo ID on our sign-in form, so that you don’t have to retype your Rogomo ID each time when you sign-in to your Rogomo Account or a cookie that helps us track repeat usage, how users arrive and leave the Rogomo Web Site and/or the Service, and other similar data. Our cookie files are encoded so that your Rogomo ID and other information can only be interpreted by Rogomo.

With most Internet browsers, you can erase cookies from your computer hard drive, block all cookies or receive a warning before a cookie is stored. Please refer to your browser instructions or help screen to learn more about these functions.

Customer Service Correspondence

If you send us correspondence, including emails and faxes, we may retain such correspondence in the records of your account. We may also retain customer service correspondence and other correspondence from Rogomo to you. We retain these records in order to measure and improve our customer service, and to investigate potential fraud and violations of our User Agreement. We may, over time, delete these records if permitted by law.

Questionnaires, Surveys and Profile Data

From time to time, we may offer optional questionnaires and surveys to our Users for such purposes as collecting demographic information or assessing Users’ interests and needs. The use of the information collected will be explained in detail in the survey itself. If we collect personally identifiable Information from our Users in these questionnaires and surveys, the Users will be given notice of how the Information will be used prior to their participation in the survey or questionnaire.

C. Our Use and Disclosure of Information

Internal Uses

We collect, store and process your Information on servers. We use the Information we collect about you in order to (1) provide our Service, (2) provide customer service, (3) determine your eligibility to receive offers for special features or products, and (4) improve our Service. We give access to individually identifiable Information about our Users only to those employees who require it to fulfill customer service requests.

Disclosure to Other Users

On the Rogomo Web Site, for each Rogomo Account, in certain circumstances we display the specific Rogomo ID chosen by the User and, if the particular User has a Rogomo Account that permits him or her to sell services and/or goods as an Expert and such User has created an Expert profile on the Rogomo Web Site, we also display any Information included in that User’s Expert profile, including, among other things (all at the discretion of the particular User), the User’s email address(es), instant messaging ID(s) and/or screen name(s), name, Web site(s), phone number(s), qualifications and a description of the services and/or goods that such User is making available as an Expert. Therefore, you should be aware that if you provide any personally identifiable Information in your Expert profile, this Information will be visible to others who visit the Rogomo Web Site.

In addition, Rogomo may share certain of your Information with other Users (a) in order to resolve a complaint about a Sale that you were involved in either as a buyer or an Expert, (b) to warn other Users of any breach of the Agreement which may negatively impact those Users, (c) to assist one or more Experts in collecting monies owed by you in connection with a Sale, and/or (d) as otherwise set forth in the User Agreement.

Users may not use information gathered through the Rogomo Web Site or the Service to defame, abuse, harass, stalk, threaten or otherwise violate the legal and civil rights of any other User. Users may not use information gathered through the Rogomo Web Site or the Service for any commercial purpose outside the scope of the Service. Email addresses and Information may not be used to forward survey contests, pyramid schemes or chain letters, or to post the same message repeatedly (a practice referred to as “spamming”). Rogomo may terminate the ability of any User to use the Service and/or the Rogomo Web Site if you engage in such behavior.

Disclosure to Third Parties

Rogomo will not sell or rent any of your personally identifiable Information to third parties. Rogomo will not share any of your personally identifiable Information with third parties except in the limited circumstances described herein or in the User Agreement, or with your express permission. These third parties are limited by law or by contract from using the Information for secondary purposes beyond the purposes for which the Information is shared.

1. We share Information with companies that enable our Users to exchange payment for services and/or goods sold via the Service, such as PayPal, and to protect against fraud. Additionally, if you fail to pay any Commissions that you owe to Rogomo, we may share Information with third parties including, without limitation, collection agencies.

2. We may disclose the Information we collect to companies that perform marketing services on our behalf.

3. We disclose Information that we in good faith believe is appropriate to cooperate in investigations of fraud or other illegal activity, or to conduct investigations of violations of our User Agreement.

4. We disclose Information in response to a subpoena, warrant, court order, levy, attachment, order of a court-appointed receiver or other comparable legal process, including subpoenas from private parties in a civil action. We also disclose Information where we in good faith believe we must make such disclosure to comply with applicable laws.

5. We disclose Information to relevant law enforcement agencies, emergency healthcare providers and other similar authorities where we in good faith believe it is necessary and appropriate to protect the health or safety of the User whose Information is being disclosed and/or that of a third party.

6. When a user signs up for a co-branded version of Rogomo through links to Rogomo from our co-branded partner’s website, Rogomo may share with the co-branded partner that user’s name, email address and physical address, log-in information and other information in order to provide enhanced integration between Rogomo’s services and the services of our co-branded partner. If you do not want your information shared with Rogomo’s co-branded partner, you should sign up with Rogomo directly and not through a link from our partner’s website.

7. We disclose Information to your agent or legal representative (such as the holder of a power of attorney that you grant, or a guardian appointed for you).

8. We share aggregated statistical data with our business partners or for public relations. For example, we may disclose that a specific percentage of our users live in New York. However, this aggregated information is not tied to personally identifiable Information.

9. As with any other business, it is possible that Rogomo in the future could merge with or be acquired by another company. If such an acquisition occurs, the successor company would have access to the Information maintained by Rogomo, including customer account Information, but would continue to be bound by this Privacy Policy unless and until it is amended as described above.

Our Contacts with Rogomo Users

We communicate with Users on a regular basis via email to provide requested services, and we also communicate by phone to resolve customer complaints or other issues. We use your email address to send information about important changes to our Service, and to send notices and other disclosures required by law. Generally, Users cannot opt out of these communications, but they will be primarily informational in nature rather than promotional.

We also use your email address to send you other types of communications that you can control, including Rogomo news, customer surveys and notice of special promotions. If you do not want Rogomo to send such information to you, please send us an email at help@rogomo.com with the Subject line of “Communication Opt Out” telling us that you do not want to receive Rogomo news, customer surveys or notice of special promotions.

In connection with independent audits of our financial statements and operations, the auditors may seek to contact a sample of our customers to confirm that our records are accurate. However, these auditors cannot use personally identifiable Information for any secondary purposes.

Internet Address Information

We use IP addresses, browser types and access time to analyze trends, administer the site, improve site performance and gather broad demographic information for aggregate use.

D. Information Security

Rogomo is committed to handling your Information with high standards of information security. We restrict access to your personally identifiable Information to employees who need to know that Information in order to provide products or services to you.

The security of your Rogomo Account also relies on your protection of your Rogomo password. You may not share your Rogomo password with anyone. Rogomo will never ask you to send your password or other sensitive information to us in an email, though we may ask you to enter this type of information on the Rogomo Web Site.

E. Accessing and Changing Your Information

You can review the Information you provided us and make any desired changes to such Information, or to the settings for your Rogomo Account, at any time by logging in to your Rogomo Account on the Rogomo Web Site and changing your preferences in the account settings. You can also close your Rogomo Account by calling or emailing us. If you close your Rogomo Account, we will mark your account in our database as closed, but will keep your Information in our database. This is necessary in order to deter fraud, by ensuring that persons who try to commit fraud will not be able to avoid detection simply by closing their Rogomo Account and opening a new one. However, if you close your Rogomo Account, your personally identifiable Information will not be used by us for any further purposes, nor sold or shared with third parties, except as necessary to prevent fraud and assist law enforcement, or as required by law.
