This User Conduct Policy (“User Conduct Policy”) was last modified on June 3, 2008.

This User Conduct Policy governs your Rogomo Account and your use of the Service. Please carefully read this User Conduct Policy, as it comprises a part of the User Agreement between you and Rogomo. For your reference, you can review Rogomo’s User Agreement here. Unless otherwise provided, terms used herein have the same meanings given in the User Agreement.

A. Code of Conduct

You will be solely and fully liable for all conduct, postings and transmissions that are made through your Rogomo Account or otherwise under your Rogomo ID and password. You warrant and declare that, in connection with your use of the Rogomo Web Site, your Rogomo Account or the Service, or in the course of your interactions with Rogomo, a User or a third party:

1. You will not breach this User Conduct Policy, the User Agreement or any other agreement or Policy that you have entered into with Rogomo.

2. You will not violate any law, statute, ordinance, rule, regulation or ethical code (for example, those governing financial services, consumer protections, unfair competition, anti-discrimination or false advertising).

3. You will not upload, post, e-mail, transmit or otherwise make available any information or material which may constitute or encourage conduct that is a criminal offense or civil wrong or otherwise violates any applicable law.

4. You will not upload, post, e-mail, transmit or otherwise make available any third party advertisements, including banner exchange services.

5. You will not infringe Rogomo’s or any third party’s copyright, patent, trademark, service mark, trade secret or other intellectual property rights, or rights of publicity or privacy.

6. You will not act in a manner that is defamatory, trade libelous, unlawfully threatening, unlawfully harassing, abusive, vulgar, obscene, racist, harmful or otherwise unlawful.

7. You will not use the Service in any manner to direct users to a service that competes with Rogomo, including, without limitation, directing any user to conduct a transaction with you through a competing online marketplace. You acknowledge that any attempt by you to direct users away from Rogomo to a competing service amounts to an intentional interference with Rogomo’s Service and Rogomo’s User Agreement.

8. You will not provide false, inaccurate or misleading information (including, without limitation, Information).

9. You will not impersonate any person or entity, or make any false statement regarding your employment, agency or affiliation with any person or entity.

10. You will not create more than one Rogomo Account or otherwise use the Service for the purpose, or with the effect, of avoiding or otherwise circumventing (i) monies owed in connection with an Account, (ii) disciplinary action taken with respect to an Account, (iii) user ratings associated with an Account.

11. You will not fail to make immediate payment of any sum that you owe to an Expert pursuant to Section 4.4, or any other section, of the User Agreement.

12. You will not refuse to cooperate in an investigation or provide confirmation of your identity or any Information you provide to us.

13. You will not use an anonymizing proxy.

14. You will not control a Rogomo Account that is linked to another Rogomo Account that has engaged in any of these Restricted Activities.

15. You will not conduct your business or use the Service in a manner that results in or may result in complaints, disputes, reversals, chargebacks, fees, fines, penalties and/or other liability to Rogomo, a User, a third party or you.

16. You will not allow be in arrears for Commissions that you owe to Rogomo.

17. You will not disclose or distribute another User’s Information to a third party, or use the Information for marketing purposes unless you receive the User’s express consent to do so.

18. You will not disclose or distribute any information, data, text, links, images, software, chat, communications or other content available through the Internet and proprietary to Rogomo (collectively, the “Content”) to a third party, or use the Content for marketing purposes unless you receive Rogomo’s express consent to do so.

19. You will not provide any unauthorized third party with access to the Service.

20. You will not send unsolicited email to a User or use the Service to collect payments for sending, or assisting in sending, unsolicited email to third parties.

21. You will not attempt to gain unauthorized access to other computer systems or networks connected to the Rogomo Web Site, and will not transmit “junk mail,” “spam,” or any unsolicited mass distribution of e-mail or bulletin board postings.

22. You will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure.

23. You will not facilitate any viruses, Trojan horses, worms or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or Information.

24. You will not use any robot, spider, other automatic device, or manual process to monitor or copy the Rogomo Web Site without our prior written permission.

25. You will not use any device, software or routine to bypass our robot exclusion headers, or interfere or attempt to interfere, with the Rogomo Web Site or the Service.

26. You will not modify, reverse engineer, reverse assemble or decompile any of the software applications used by you in connection with your participation in the Service.

27. You will not take any action that may cause us to lose any of the services from our internet service providers, payment processors, or other suppliers.

28. You will not take any actions that may undermine, disrupt or manipulate the integrity of the User feedback (rating) system on the Rogomo Web Site. Currently only ratings for paid sessions of a length to be determined by Rogomo will count towards each User’s public ratings and rating average. Rogomo may change the above-mentioned minimum session fee at any time and without warning, and even remove old ratings given for paid sessions with a fee lower than any newly set minimum fee. Rogomo also reserves the right to exclude without explanation any rating that we think may compromise the integrity of the member feedback system.

B. Your Relationship With Other Users

Privacy of Others

If you receive Information about another User through the Service, you must keep the Information confidential and only use it in connection with the Service. You may not disclose or distribute a User’s Information to a third party or use the Information for marketing purposes unless you receive the User’s express consent to do so.

Copyright Policy

Rogomo respects the intellectual property of others, and we ask our Users to do the same. Rogomo may, in appropriate circumstances and at its discretion, terminate the Rogomo Account of access of Users who infringe the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide Rogomo’s Copyright Agent the following information (collectively, “Notice”):

1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;

2. A description of the copyrighted work that you claim has been infringed, including the URL (web page address) of the location where the copyrighted work exists or a copy of the copyrighted work;

3. A description of where the material that you claim is infringing is located on the site, including the URL;

4. Your address, telephone number and email address;

5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent or the law; and

6. A statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

C. Unacceptable Uses

Without limiting any other provision of this User Conduct Policy, the User Agreement, or any other Policy, the following activities are unacceptable uses of the Service and may subject you to fines by Rogomo as set forth in Section 9.4 of the User Agreement:

a. Using the Service to facilitate payment for any obscene materials or services in violation of any Federal, State or local law or ordinance;

b. Using the Service to facilitate payment for any narcotics, other controlled substances, steroids or prescription drugs;

c. Using the Service to facilitate payment for wagers, gambling debts or gambling winnings, regardless of the location or type of gambling activity; and

d. Using the Service for the purpose, or with the effect, of avoiding or otherwise circumventing (i) monies owed in connection with an Account, (ii) disciplinary action taken with respect to an Account, (iii) user ratings associated with an Account.

D. Violation of this User Conduct Policy

If we reasonably believe you have breached any portion of this User Conduct Policy, we may, in our sole discretion, at any time and without prior notice, suspend or terminate your use of or access to the Service, and/or seek any available legal recourse.
